 Q: What is a homeowners association?

A: It is a non-profit corporation registered with the State and managed by a duly elected Board of Directors. Its purpose is to maintain all common areas and to govern the community in accordance with the provision of the legal governing documents: CC&Rs, By-laws, and Articles of Incorporation. The corporation is financially supported by all members of the homeowners association. Membership is both automatic and mandatory.  To  view the Governing Documents, please click here.

Q: What are the CC&Rs?

A: The Covenants, Conditions and Restrictions (CC&Rs) set up the guidelines for the operation of the planned community as a non-profit corporation. The CC&Rs were recorded by the Orange County Recorder's office and are included in the title to your property.  Please click here to view the CC&Rs.
                                                                                                                               
                                                                                                                                                       Q: What are the By-laws?

A: The By-laws are the guidelines for the operation of the non-profit corporation. The By-laws define the duties of the various offices of the Board of Directors, the terms of the Directors, the membership's voting rights, required meetings and notices of meetings, and the principal office of the Association, as well as other specific items that are necessary to run the Association as a business. Q: What is the Board of Directors?

A: The Homeowners Association  is a corporation and, therefore, a governing body is required to oversee the Association's business. The Board of Directors is elected by the homeowners in accordance with the provisions of the By-laws and the Association's Election Rules.  (For a list of the current Board of Directors, and contact information, please click here.)
                                                                                                                                                    
Q: Are there any other rules besides the CC&Rs?

A:  The Board of Directors has adopted policies and rules over the years to provide direction with regard to use of the Sun &  Sail Club and its facilities; parking and other vehicle matters; pets; etc. These have been adopted in the interest of safety, courtesy, and other considerations.  Click here to view "Rules and Policies".
     In addition, the Master Architectural Committee (MAC) has established Architectural Guidelines to address homeowners' requests to change the exterior appearance of their homes by means of architectural improvements.  These improvements include new roofing, doors, windows, driveways, landscaping and hardscape, tree removal, house paint colors, gazebos, patio covers, etc.  These Guidelines are intended to maintain the aesthetics and character of our neighborhoods, thereby protecting the market value of your investment.  All exterior home improvements, whether they will affect the front or the back yard, must first be approved by the Master Architectural Committee.  To view the Architectural Guidelines online, please click here.
                                                                                                                            
Q: If I am having a problem with a neighbor for a violation of the CC&Rs, what can I do?

A: If you are concerned that your neighbor is violating the CC&Rs or other Association rules, you may report the situation by contacting the Community Relations Manager or the Community Services Department.  (Click here for contact information.) An Inspector will be sent to the property to investigate the situation, and will follow up with a notification (citation) to the homeowner if there is an observable violation.  There are legal timeframes involved with CC&R enforcement, and the length of time it takes to have the violation corrected may depend on the willingness of the violating homeowner to comply in a timely manner.  Be assured that even if you don't see any improvement taking place right away, the Association is taking the prescribed steps to gain compliance. 
     If your dispute with your neighbor does not involve the CC&Rs or other Association rules, the Association has no authority to intervene.

Q: Are Board Meetings open to all residents? If so, where and when are they held?

A: Yes, and we highly encourage attendance and participation by the homeowners.  The regular Board of Directors meetings take place on the first Wednesday of each month, at 7:00 p.m. at the Sun & Sail Club.  Agendas are posted on this website within a week prior to the meeting, and also in the display case outside the entrance to the  Sun & Sail Club.  (Note:  When a holiday falls on or near the first Wednesday of the month, the Board meeting is rescheduled to a date approved by the Board--usually the following week.  The exact date will be announced on this website, as well as in The Mainsheet newsletter.)   To view the upcoming Board Meeting Agenda, please click here.
                                                                                                                                                    
Q: If I want to serve on a committee, how I can get involved?

A: The Contacts page of this website lists the committees and committee contact information. When there is a vacancy to be filled on a committee, we put out a call for volunteers on this website and in The Mainsheet newsletter.   If there is a vacancy, you are invited to complete and submit a " Volunteers Policy/Application" form, available here.
